How AbsenceSoft Manages the Law
AbsenceSoft manages this law through 1 policy.
-
Policy Name - Louisiana Living Donor Leave Protection Act
-
Policy Code - LA-LDLPA
-
Benefit Type - Job Protected
Employer Coverage Requirements
Refer to Legislative guidance for details.
Excluded Employers
π Configuration Note: LA-LDLPA is configured to apply to Louisiana private-employer employees by default.
β Manual Action or Tracking Required: Excluded employers are not covered under the law and may need to disable the policy in the platform to keep it from displaying. Discuss decisions with legal counsel for best approach.
π‘ Best Practice: Public-sector employers, such as state agencies, are outside the scope of the core LA-LDLPA policy. State agencies subject to separate obligations under this law can customize this policy and change the policy type to Company to show the policy is owned by the employer.
Employee Eligibility
Refer to Legislative guidance for details.
Eligibility Exceptions
Excluded Employees
β Manual Action or Tracking Required: Manually override eligibility for excluded employees or for those who have not opted into the program by changing eligibility from pass to fail.
Leave Entitlements and Duration
Refer to Legislative guidance for details.
Entitlement Overview
Each LA-LDLPA absence reason has an entitlement of 30 calendar days per case.
-
Organ Donor
-
Marrow Donor
β Automatic: LA-LDLPA automatically tracks up to 30 calendar days of entitlement per case for each absence reason.
Entitlement Rules
Organ Donor and Marrow Donor each carry their own per-case entitlement of up to 30 calendar days. The two absence reasons do not share entitlement.
β Manual Action or Tracking Required: Submit each separate donation as its own case so that each receives its own 30 calendar day entitlement. Entitlement is tracked per case and is not aggregated across cases.
Interaction with other Policies
Refer to Legislative guidance for details.
π Configuration Note: LA-LDLPA's absence reasons are configured in a way that may affect whether certain other leave policies display concurrently on the same case.
β Manual Action or Tracking Required: Case managers should review whether an additional case is needed to track leave under other potentially applicable leave laws when a donor absence reason is selected.
Managing In-Flight Cases
π Configuration Note: The LA-LDLPA policy effective date is set to August 1, 2025 so the policy can be applied to cases already in flight when the law takes effect on August 1, 2026.
Cases Spanning August 1, 2026
β Manual Action or Tracking Required: Review active cases that were open before August 1, 2026, continue on or after that date, and involve organ or bone marrow donation. Absence reasons to review:
-
Organ Donor
-
Marrow Donor
To apply the policy to a qualifying in-flight case:
-
Identify the open case spanning August 1, 2026.
-
Manually add LA-LDLPA to the case.
-
The policy should start on August 1, 2026.
π‘ Best Practice: Document the change in case notes, for example: "LA-LDLPA added retroactively for in-flight case effective 08/01/2026."
β Manual Action or Tracking Required: Create a list of potentially eligible in-flight cases before August 1, 2026 so none are missed.
